In this case, likely the only issue is intent. Intent and character certainly interplay. Did she go to his home with the intent of executing him? Or did she make a stupid mistake? Our justice system treats the situations differently. No one is saying she is innocent, the question appears to be what crime?

And yes, if you hit a pedestrian, the speed you were going matters.

Everything matters at this point. Character matters because of facts in dispute and intent.
what facts are in dispute? is it in dispute that it was his home she trespassed into? is it in dispute that the given reason was mistaking his home for her own? what drugs he happened to do is irrelevant to this case, altogether.
