If he had shot the kid in the store, I'd be on Foo's side of this argument. Or if the guy had just called cops and told them he fired at the kid and didn't know if he hit him or not. As it stands he should face involuntary manslaughter at most.

I didn't say it wasn't murder I said it wasn’t first degree murder. It's at best second degree murder. A brainwashing job on society has been done that allows people to think crimes like stealing are somehow not serious. This attitude destroys entire communities. Wanna bet that store is already built like a jail because of it, with bars on the windows and security measures everywhere? I have no pity for the kid thieves get shot all the time it's a risky hobby and the dramatic response probably comes from being robbed regularly but the shooter also fucked up and has to answer for his actions.

Good strategy. If he blew his brains out in the store, he could have damaged inventory. This way nothing of value was lost.
On a serious note, we should also examine why he lacks any faith in the police there, and why he did not call them after shooting.

I tell ya what, if that guy shot your kid or wife while shooting a kid for stealing a beer while running after him, I think the tone would shift. Maybe it's me, but this sounds irresponsible as all fuck. This isn't Death Wish part 16.

I am thinking plea bargain for probation. Dude doesn't deserve jail.
