When in the process of stealing a beer, you are putting yourself at risk of getting shot. Just because he made it out the door doesn't mean he should get away with it.

Sounds like a weird semantic argument. It does seem like 2nd degree then. Unless having the gun there and ready is premeditation.

I am thinking plea bargain for probation. Dude doesn't deserve jail. Just tell him next time to shoot him in the face right in the store and it won't be an issue.
You can't kill people for shoplifting man its not the middle ages.
If progress means less respect for other people's property, count me out. This is why people think it is not so bad. I am not advocating a trial and execution, but if a person gets killed by a property owner protecting his property, that is great. That man in the store is working for a living and stealing from him is causing harm he does not deserve.

I grew up in a farming area. If you were to be messing with a farmer's equipment, getting shot is the expected result.

What if you ran over someone in a car on the way to work? It could be a crime, but you didn't.

You think that was the last crime that kid was going to commit? What that kid stole is inventory that allows that man to feed and house his family. Are you going to replace his lost inventory? How about the police? If someone walked up and ripped the money out of your hand that was gonna be used to feed your family, would you fight for it? Or just give it up?

People should not have to live in fear of being a crime victim. Glad the victim had a gun, maybe it dissuades the next thug.

Here we go...

The angel that was stealing alcohol from corner stores had asked his grandma if he could stay at his cousins house, and she reminded him to be home for church on Sunday, and he agreed. Was wondering how the tale of why his family did not know he was missing would be spun.

I am sure he and his cousin were studying that night, too.

i don't think he's a bad guy for doing what he did. just acted without thinking. but he still killed someone. it's still murder and he should be punished for murder.

and if it had been me that had killed someone, i would absolutely expect to be punished for it.

this is no better than gossip or rumor. it's meaningless. it doesn't add anything to the conversation. i could speculate that the shooter didn't call the cops at all, because he needed the time to cover his ass, or to come up with something convincing that would justify coldblooded intentional murder. but it's stupid and it doesn't serve anything.

But that’s mainly because he went out of his way to murder someone.

When someone attempts to take something that is yours, tell me the exact level of response you are allowed to have.

- if someone says to give them your car, must you hand it over?

- if someone tries to grab your wallet, can you hang on to it?

- if someone tried to take your child, must you allow them?

no, to all three. i would have reason to keep him from taking my car, my wallet, and my child. if he was unarmed and i shot him, i would also have reason to be punished for all, but possibly him trying to take my child (or sibling / family member, as i don't have any children)

When you resist, are you not escalating the potential of violence? If your resistance of theft leads to an escalation that ends up with the thief dead, is it your fault?
